Terms of Use

These Terms of Use (the "Terms") govern your access to and use of the websites and web tools operated by Pong Studio ("pongvn", "we", "us") — including pongvn.com, toolio.pongvn.com, GGReflex, Trynkit, Tesil, Tilebrush, and other pages under pongvn.com and its subdomains (collectively, the "Sites"). By using the Sites, you agree to these Terms. If you do not agree, please do not use the Sites.

Specific products (for example mobile games distributed through app stores) may carry additional terms; where they conflict, the product-specific terms govern for that product.

Eligibility

The Sites are intended for a general audience. You must be at least 13 years old (or the minimum age required in your country) to submit personal information such as an email address.

Use of the Sites

We grant you a personal, non-exclusive, non-transferable, revocable permission to use the Sites and tools for lawful purposes. You agree that you will not:

  • use the Sites in violation of applicable laws or third-party rights;
  • upload or process content that is unlawful, infringing, or that you do not have the right to use;
  • probe, scan, or test the vulnerability of the Sites, or bypass security or access controls;
  • interfere with the operation of the Sites — including denial-of-service, spamming our forms, or automated bulk requests that degrade the service for others;
  • scrape, harvest, or mass-download content or data beyond what normal personal use requires;
  • fraudulently interact with advertising served on the Sites;
  • misrepresent your affiliation with Pong Studio, or use our names, logos, or branding without permission;
  • resell or offer the Sites' tools as your own service without our written consent.

We may limit, suspend, or block access (including by technical means such as rate limiting) if we reasonably believe these Terms are being violated.

Your content and files

  • You keep ownership. Files, text, and other content you load into our tools remain yours. We claim no rights over them.
  • You are responsible for having the necessary rights to the content you process, and for how you use the results.
  • Most tools process your content in your browser; certain labeled tools process it transiently on our servers and delete it immediately after returning the result (see our Privacy Policy).
  • No storage service. The tools are processors, not storage — results are not retained for you, and we are not responsible for loss of content. Keep your own copies.

Tools are informational — no professional advice

Calculators, converters, and similar tools on the Sites (for example BMI or body metrics, loan/interest, salary, tax or fee estimates, unit and currency conversions, text and file utilities) produce general-purpose, informational estimates only. They may not reflect your individual circumstances, current regulations, or market values, and they are provided without any guarantee of accuracy or fitness for a particular purpose. They are not medical, financial, investment, legal, or tax advice. Always verify important results with a qualified professional or the relevant institution before acting on them. Exchange rates and similar reference data are indicative and may be delayed.

Games and virtual content

Browser games and any scores, rankings, or virtual items within them are provided for entertainment. They have no monetary value, may be reset or changed for integrity or technical reasons, and may differ from any future downloadable products.

Email updates

If you subscribe for updates, we will send you occasional product news. You can unsubscribe at any time; doing so does not affect your ability to use the Sites.

Intellectual property

The Sites and their content — including software, design, text, graphics, logos, game art, and trademarks — are owned by Pong Studio or its licensors and are protected by applicable laws. Except for the personal use permitted above, you may not copy, modify, distribute, publicly display, or create derivative works from the Sites without our written permission. Third-party names and marks referenced on the Sites belong to their respective owners; references do not imply affiliation or endorsement.

If you send us feedback or suggestions, you grant us a perpetual, royalty-free license to use them without obligation to you.

Third-party links and advertising

The Sites contain links to third-party websites and display third-party advertising (including Google AdSense). We do not control and are not responsible for the content, products, policies, or practices of third parties. Your dealings with advertisers are solely between you and them.

Availability and changes to the Sites

The Sites are provided free of charge. We may add, change, suspend, or remove tools, features, or content at any time without notice, and we do not guarantee that any tool will remain available.

Disclaimer of warranties

THE SITES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT RESULTS PRODUCED BY THE TOOLS WILL BE ACCURATE OR RELIABLE.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PONG STUDIO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATING TO YOUR USE OF THE SITES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SITES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US TO USE THE SITES IN THE TWELVE MONTHS BEFORE THE CLAIM (THE SITES ARE FREE, SO ORDINARILY ZERO) OR FIFTY U.S. DOLLARS (US$50). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU; NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW, OR AFFECTS STATUTORY CONSUMER RIGHTS THAT APPLY IN YOUR COUNTRY.

Indemnification

You agree to indemnify and hold Pong Studio harmless from claims, damages, and reasonable expenses arising from your violation of these Terms or your unlawful use of the Sites, to the extent permitted by applicable law.

Governing law

These Terms are governed by the laws of Vietnam, without regard to conflict-of-law rules. Disputes will be resolved in the competent courts of Vietnam, except where the mandatory consumer protection laws of your country of residence provide otherwise.

General

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a reorganization or transfer of the Sites. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Sites.

Copyright and content complaints

If you believe content on the Sites infringes your rights, email [email protected] with the content URL, a description of the claimed infringement, and your contact details. We review and act on valid notices.

Changes

We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above. Continued use of the Sites after changes take effect means you accept the revised Terms.
